Child Care Leave Rules for Central Government Employees

The Central Government recognizes the importance of supporting the welfare of women employees, especially those who are also mothers. To this end, they have established Child Care Leave Rules for Central Government Employees. These rules provide women with the opportunity to take time off from work to care for their children. This allows them to balance the responsibilities of work and motherhood, ensuring their physical and mental well-being. Under these rules, eligible women can take up to 730 days of leave, which can be taken in installments or all at once. This valuable benefit is a testament to the government’s commitment to gender equality and family-friendly policies.

7th CPC Child Care Leave

According to Rule 43-C of the Central Civil Services (Leave) Rules, 1972, female Government servants working in the Civil Services or posts related to Union affairs are eligible for Child Care Leave (CCL). This leave allows them to take care of their two eldest surviving children up to the age of 18 years for a maximum period of seven hundred and thirty days during their entire service. However, there is no age limit in case of a disabled child. The leave can be taken for not more than three spells in a calendar year, except for a single female Government servant who can take up to six spells in a year.

CCL cannot be granted during the probation period as per Rule 43-C (3), except in extreme situations where the sanctioning authority is convinced of the need for CCL to the probationer and the leave period is minimal. It should be noted that CCL is not a right and cannot be claimed without prior approval from the concerned authorities.

Amendment on CCS (Leave) Rules 1972

As per the amendment of CCS (Leave) Rules 1972, the CCL may be granted at 100% of the leave salary for the first 65 days and 80% of the leave salary for the next 365 days. CCL may be extended to single male parents who may include unmarried or widower or divorcee employees. For Single female Government servants, the CCL may be granted for six spells in a calendar year. 7th Pay Commission Report on Child Care Leave (CCL)

The 7th Pay Commission Report has addressed the issue of Child Care Leave (CCL), which is a benefit provided to female employees for a maximum of two years (730 days) during their entire service to take care of their minor children (up to eighteen years of age). The report has received numerous demands regarding CCL, including converting it into “family care” leave, extending the benefit to male parents, and allowing single male parents to avail of the same. Additionally, suggestions have been made to eliminate the clause requiring the child to be a minor in cases where the child is differently-abled. Single mothers have also raised concerns about unique challenges they face and have requested more liberal access to CCL. Interestingly, some representations have been made for discontinuing CCL, citing disruption of office work and concerns about gender discrimination.

7th CPC Analysis and Recommendations on CCL

When Child Care Leave was first introduced by the VI CPC it generated considerable interest as it represented a positive measure benefiting women employees. It also took a while to stabilize and it is seen that as many as five amendments/clarifications were issued within a short period of time. As it stands, it is meant for women employees “for taking care of up to two children whether for rearing the children or looking after their needs like examination, sickness etc.”

It is treated akin to Earned Leave and is sanctioned as such. It may not, however, be granted in more than three spells in a calendar year. In the first two years of its implementation, the experience was that women employees tended to treat this as Casual Leave or an extension of the same, and the resultant frequent absences caused disruptions at work.

To address this, in September 2010, a clarification was issued stipulating that CCL may not be granted in more than three spells in a calendar year and also that it may not be granted for less than 15 days at a time. However, the latter stipulation was subsequently withdrawn and as per the latest clarification issued on 5 June 2014, the government has decided to remove the requirement of a minimum period of 15 days of Child Care Leave.

It has been brought to the notice of the Commission that the capping of a maximum of three spells in a calendar year has, to some extent, addressed the problems relating to disruption of work. Notwithstanding that, in the course of discussions with various stakeholders, the sense that has come across is that what was introduced as a welfare measure to help employees in times of need, is seen as a benefit that has to be availed simply because it exists.

There is, therefore, a palpable need to bring in some inhibiting feature so as to ensure that only genuinely affected employees avail of this scheme. Towards this end, the Commission recommends that Child Care Leave should be granted at 100 per cent of the salary for the first 365 days, but at 80 per cent of the salary for the next 365 days. In making this recommendation the Commission has also kept in mind the fact the concept of a paid (whether 100% or 80%) leave solely for child care for a period of two years, is a liberal measure unmatched anywhere else.

The Commission notes that in the event a male employee is single, the onus of rearing and nurturing the children falls squarely on his shoulders. Hence extension of CCL to single male parents is recommended. Moreover, the Commission recognizes the additional responsibility on the shoulders of employees who are single mothers. Accordingly, is Report of the Seventh CPC 365 Index recommended that for such employees, the constitutionality of three spells in a calendar year should be relaxed to six spells in a calendar year.

Child Care Leave Rules and Restrictions

  • Female employees are those who may be authorized by the competent leave-granting authority to take CCL.
  • What is the permissible salary for female employees during the period of CCL? Female employees on CCL are entitled to receive leave salary equivalent to their current pay immediately prior to commencing their leave.
  • “Is it advisable to only obtain CCL in a single instance? It is possible to obtain CCL in multiple instances.”
  • It is not recommended to debit CCL from the leave account. It is advised that CCL should not be deducted from the leave account.
  • It is permissible to grant Child Care Leave (CCL) for the third year as leave not due, even if there is no medical certificate produced. This means that CCL can be availed for the third year without any documentation of medical reasons.
  • In cases where a female employee has more than two surviving children under the age of 18, it is necessary to determine who is eligible to receive Child Care Leave (CCL). Specifically, CCL will only be granted for the two eldest surviving children.
  • Would Saturdays, Sundays, and Gazetted Holidays be counted for CCL during the leave period, similar to Earned Leave?
  • The maximum number of spells for which CCL can be granted is limited to three in a calendar year.
  • “What is the duration required for the approval of CCL for a singular period? The minimum duration for which CCL can be granted is 15 days for a single spell.”
  • Could Child Care Leave be granted to adoptive mothers in relation to their adopted minor children? The guidelines for awarding CCL do not make a distinction between biological and adoptive mothers, therefore adoptive mothers may also receive CCL as long as they meet the eligibility criteria set for the leave.
  • In the event that CCL (Compensatory Casual Leave) is initiated in December and extends into January of the following year, there may be confusion as to whether it should be classified as a spell of CCL for the previous or the upcoming year. It is important to note that the CCL must have been authorized in December of the preceding year or earlier. As a result, this CCL spell will be regarded as belonging to the year in which it was initiated.
  • The benefit of Child Care Leave (CCL) is granted to mothers of disabled children up to the age of 22 years, provided that the child has a minimum disability of 40%. This information has been detailed in the notification No.16-18/97-N.I, dated 1.6.2011, by the Ministry of Social Justice & Empowerment.
  • According to the current regulations, an individual is eligible to take any type of leave for a duration of up to five years at a stretch. The question arises whether the Child Care Leave (CCL) should also be considered within this five-year timeframe. The answer is yes, the CCL falls under the scope of the maximum five-year leave provision.

    I am Central government employee of Autonomous body. If a lady is on maternity leave from 30.05.2022. Further, Child care leave from 26.11.2022 to 24.02.2023.

    My increment was due on 01.01.2023.

    Please clarify whether I will get increment for Jan and Feb month?

      yes, since you are single parent now, you can avail 720 days of Child care leave, thrice every year, at least 5 days at a time.Full basic will be paid upto first half of ccl amd then 80 percent basic with proportionate da, full hra and tpt (as per rule)

      CCL cannot be converted as encashment, but HALF PAY LEAVE may be given as be treated with Earned Leave balance including limited to 300 days at the time of retirement.

      Any kind of leave cannot be taken as a matter of rights as per the leave rules. It will be sanctioned at the descriptions of the sanctioning authority. Especially CCL is having no balance account, it may be sanctioned at such spells in year and total CCL may be sanctioned in full limit of service with reasons of children upto 18 years.

    It Should be calculated for 100 percent salary as it has not taken continuous for 730 days. i,e, for 1st children 365 days and two years after for 2nd children.

      Normally first full year 100% of salary CCL if sanctioned & CCL continues second year on wards 80% of salary as per the 7th CPC.

      Any leave cannot be asked as a matter of rights. If you have availed CL/E.L., period of leave, availability
      of staff strength, situations of the Institute the sanctioning authority may sanction the leave applied.

      You have to compete probation period. CCL is given on the basis of children sickness & for the education purpose i.e. Exams for them.

      Better join on 13-2-21 afterwords any time take CCL then increment will be given. Otherwise maternity leave and CCL combined more than 180days increment will be postponed to next year July. If you require combined both leave within 180days you avail and joints duty. CCL can avail service in 2 years upto the age of child complete 18 years.

      No. Since you have combined crossed 180days, so you will get increment on 1-7-21 only. Also total E.L. 20 days & HPF 20days will be reduced in the respectively years 2019 & 2020 Proponationly.

        Sir,but won’t I get increment on 01.06.2020 which is my joining date as my general increment date is 01.07.2019 according to my joining date 22.11.2017? And also will I not get another increment on 01.07.2020 which is my regular annual increment ? O.M.No.16/13/88-Estt.(Pay-I) dt.16.02.1989 says increment will be given on joining date after leave without affecting the next date of increment.

          It will be applicable only on Maternity leave alone. You have combined with CCL so it counts total more than 180 days. If you only availed maternity leave (or any other leave total not less than 180 days) the rules apply on increment from joining date.

              As F.R.26,GIO (3) qualifying service of less than six months 180 days) on account of any leave period will have the effect of postponing the increment. As per the leave rules under 25(1) also will not counts for increment.

    I am from Assam and i m a employee of health deptt. I m working in medical college and hospital. Here CCL is closed for mother .Nobody can complain for it .I have a 3.5 months baby, i will joined my duty in feb/2021.After my joining my baby will not take my mother milk. Is it right for my baby. Everyone knows that mother milk is essential till 6 months of babies. Any body can help me to complain it to the correct way and correct person. I dont know how can i complain it and to whom. please tell me the correct way for my little baby.

      Complaint is not a solution. As per leave rules any leave cannot be sanctioned as a matter of rights, so you have to adjust with your problem.

    I have already availed 50 ccl more than 365 till august 2019. In the month of sep 2019 my office circulated a notification that ,those employees who have availed ccl after december 2018, have to surrender 20% of the salary. Is there any Gazette notification? We were not informed about this before availing ccl.

      It is in 7th. CPC report. It is good to surrender notice. It is their mistakes to recommend your leave after 365 days in more than 3 spells. If order comes they will recover with amount with penal interest with normal interest. Better to. convert as E.L.

    I am a single mother my husband has expired 10 years back and I have exausted 360 days CCL when my son was small now my son is in Xth std n I am in need of CCL but my 20% of salary will be deducted which is not fair since my family is totally depends on my salary as I don’t get any pension since my husband was pvt employee. Kindly relax 20% of deduction to single mothers instead of granting in 6 spells.

    What if the employee is a male with a differently abled child and the child’s mother is living elsewhere? Does that not make the male employee at par with Single fathers, though not “Unmarried / Widower / Divorcee”? What should he do in such a case to avail the CCL and discharge his duties as a father of a differently abled child?

        I work as a Junior Engineer with Bharat Sanchar Nigam Limited at Nagpur (Maharashtra). I had appealed to the Board of Directors, BSNL for Grant of Child Care Leave so that I could look after my child in his mother’s absence (mother is pursuing a course pertaining to the child’s disability at Delhi, resides at a hostel, and needs to focus on her studies). I would like to apprise you that BSNL follows the CCS (Leave) rules by Govt. Of India set by the DoP&T. As per the DoP&T Notification Dated.11.12.2018, CCL is available for Single Male Govt. Servant. The notification defines Single Male Government Servant as an unmarried or widower or divorcee Government Servant.
        To my dismay my plea was rejected by my organisation citing the reason that I am “not a Single Male Government Servent, as such” and hence not covered under the existing provisions. It is rather painful and unfortunate that the very principle behind the provision of CCL single male employees is being ignored and only the rule is being adhered to; the letter observed, but the spirit relegated into oblivion.
        I have been writing to DoPT, MoSJ and places, and have been running from pillar to post What should be the correct course of action?

      This is to inform you that it has so many restrictions are there 1) It may not be granted in more than three spells in a calendar year. 2) It will be given for two children in full service. upto the eighteenth years of child.
      3) More over after maternity leave it will be given continues with the medical certificates of the child’s heath from CHGS/Doctors will not give continues certificate if the condition of child is more sevior. 4) The Controlling Officer/Head of the Department may not sanction due to the condition of Office staff position.. 5) After the Maternity leave in CCL period of 180 days increment will be postponed to next year only. In any one of the condition it will not be taken/sanctioned by the individual/Officer or continues leave in first 365 days. So your question does not arise to is purview. In view of this there’s no orders to deduction of 20% of salary after 365 days.

      As per the Court decision if your son can stay with you & also as per the employee you can avail CCL with the reason of your son’s education purpose or his sickness with medical certificate you can avail it, in three spells in a year, if your Head of the Officers sanctions your CCL. (It cannot be asked as a matter of rights).

      If you got the CCL for reasons of child sick you should get the medical certificates, if you are in covered CGHS you give the prescription from dispensary is enough.

      Not yet issued but it is only recommended. Moreover it will be sanctioned 3 spells for 2 children and after every 180 days annual increments will be postponed to every next years. Moreover it will not be sanctioned by the authorities due to the work load of available staff.

    Sir, as per the recommendation of 7th CPC, child care leave will be 730 days. For 1st spell of 365 days leave the pay and allowances will be 100% and for the 2nd spell of 365 days leave, the pa;y and allowances will be 80%. But my question is without any specific order by DOPT, can a central govt. office deduct the pay and allowances into 80%. Sir recommendation is the different thing but if their is any order issued by DOPT then the central govt. offices bound to follow the order. Sir if their is any circular/order regarding the above subject please mention the same immediately if possible.

          At this stage it is recommendation only, but it has so many condition to avail at that stage of more than 365 days. Actually it should be in 3 spells for the reasons for 2 children on the age upto 18 years.. If more than 180 days increment will be postponed to next year July only.. First condition is it cannot be asked as a matter of rights. It is only sanctioned if the work cannot be suffer in office, as per description of sanction authority of the Head of Officer/Controlling Officer.

    As per Ms Teena query for availing CCL when child is born in 22nd aug 2000, same query is here also, as per circular it says 18yrs of age for CCL, but when its running 18years, not completed 18years than cant we take CCL as the child is yet to complete 18years, and especially single mothers are in very difficult situation as their ward is in board exam .Pl share views and let us know cant we take CCL in this case.

      Answer to NANDAN : Orders of DOPT are not automatically applicable for the employees of CPSU/Autonomous bodies, Banks etc. It is for the applicability of rules/instructions issued for central government employees to their employees In connection. with their administrative ministry by giving representation of the employee.

    I am working in a co operative bank in punjab. I am on maternity leave. Now i want to take child care leave for six months. What should i do? Weather i am eligible for it?

    I work in NLC India Limited(A Navratna Company). Here our CCL rules are like only differently abled children’s mothers are allowed to take CCL. Whether every company can frame its own policies wrt to CCL?

    Request release the order of ccl for single male parents immediately. Arrears has not been paid to us, but you can implement the order wef 01 Jan 2016.

    I observe that the ccl leave recommend for ladies who are mother or for single fathers but what about the single unmarried female who has to look after her parents where there is no. one to look after.Will they are eligible for family care leave?

    A colege teacher is enjoying 82 days more leaves per year in comparison to a female school teacher. I think this must b stopped for colege teachers with imediate effect. Govt should seriously take note of it

    By going through the earlier comments (any one can go through), I realize that the CCl is perceived in a very negative sense by many male employees/ employers. It is part of every family irrespective of whether working wife or not that the children need due care for their grooming and proper development. As some body has also pointed out that the institution will ruin and become non functional if this continues, I would first of all like to thank him/her for having understood the importance of an employee especially a woman employee for largely contributing to her institution to the extent that her absence would really cause a loss. secondly it is my feeling that a child is very important entity in the family solely dependent on his/ her mother who feeds and grooms. so I am obliged to the government for this decision of providing the child care leave for the women employees and also single men.

    When ever a lady goes on CCL she has to hand over her charge to other. In such she should hand over the charge to another lady counter part. Otherwise most of the time it is observed that most of the lady employees take CCL either when there is big work load or if other lady employee is going on CCL. In such cases the men counter part is given all the load and he has no other option which ultimately affects his wife and his children….. So while some children get their mother and some children are angry with their father. Upon that since these leaves are applicable to only govt and psu’s those mothers whose mothers are working with pvt sector and fathers working in govt or psu’s suffer hell lot….. Hence my suggestion is if both parents are working specially when mothers in pvt sector and father in govt or psu’s then these CCL should be given to fathers also or there is grave injustice done to those who at time don’t see either of them.

    The first condition was little bit right that when there is no kind of any leave, the ccl was allowed to avail. That time there was not much misuse. In my knowledge some officials are availing without any reason as their children attaining 18years. In my opinoin ccl should be given when there is sny kind of leave to the really needy official the age of the children should also curtail. Becacuse of ccl the office works suffers and the male officials not getting leave when the are very badly needed. It is my point of view.

    the child care leave has become an instrument of severe malutilisation of the spirit with which it was started. Many female employees are harassing the administration in the name of CCL. This must be stopped and the duration of CCL should be reduced to 6 month only , otherwise all the government institutions will soon become non-functional.

    Why are Central Govt employees entitled to 730 days of CCL but women officers in the Armed Forces are entitled only to 365 days. the distinction is not understood considering a woman central govt employee is a central govt employee irrespective of whether she is in the armed forces or not. also since she goes through a birthing process and challenges of motherhood no dfferent from other central govt employees the distinction is not constitutional or logical.This issue needs to be addressed by the Government asap

    Limitation of CCL to three spells in a calendar year is against the spirit of granding CCL. CCL is granted to take care of child then how come a child’s need related to exam+sickness be restricted to thrice in a year. If CCL is applied is for a small spell then it should be at least six times in a calendar year.

    CCL facility should be for Male employees also. Today when we say much more about equality of Man & Women on the other hand Govt introduces facility on the basis of discrimination which is totally wrong and injustice to Male. Father is getting paternity leave then why not CCL? It is unfortunate that so called literate women are silent against the injustice to Male.

    The concept of CCL is wrong. It seems that Govt thinks no responsibility of father in bringing up of child. It is unfortunate. This facility should be challenged in court for justice to male.

    The provision of punishment as disciplinary action should be there in case of misuse of this facility.

It should be kept in mind that child care is not only responsibility of mother and child require father also then why CCL is for mother only? It is totally wrong and injustice to Male employees. It seems that Govt made this one sided facility to get women’s vote. C CL should be challenged in supreme court. Because this facility is on the basis of gender discrimination.

    This CCL was introduced in the 6th pay commission report. As per the report it is limited upto two children completing 18 yrs of age. At the time wen it was introduced many employees took whole two years leave when their youngest was 16. This means many ladies have enjoyed full 2 years period wen it was required or not. Now only those ladies are left who genuinely needed this leave. And now this clause comes of 80%. if this has been introduced earlier then those ladies who took it as a matter of right should also not have taken the leave. But now only 1 year leave is granted on full pay which I think most of the ladies have taken and if now they want to take this leave they have to bear good financial loss. I too don’t agree to this. First give the privilege and then take back. Mothers are the building blocks of the nation. If she is taking leave for the education, sickness etc of the children, a good role model for the nation is also being prepared by her. She gives her fullest to the child. I think Govt should think over this issue again.

    Men employees are less paid and than women employees of same rank/post. Several years extra with-pay leave (so Called Child Care Leave) is allowed only to women employees while men employees are not only deprived of such with-pay leaves, they (men employees) are also made / compelled to do the extra work-load of their women counter parts when those women employees happen to be on leave. This is a gross unfair exploitation of men. The situation becomes a gross injustice to the single-parents male employees who alone, for being a single male-parent, has to take care of his own children. Though 7th CPC has proposed to grant CCL to single male parent also but, for some unknown reasons, the same has not yet been implemented.

    It defeats the very purpose of Child Care leave that 80 per cent salary for last 365 days.It means if woman is taking leave leave for a child she has to suffer financial loss.It shows apathy and non sensitivity of commission to child and it’s development.Educational fees,tution fees everything will be sam and salary reduced.!What a joke!
    If any child is sick with disease like cancer and his mother will have to suffer financial loss,the price for being near to child is real cruelty.
    Moreover only 3 slots per year should be removed.If it is 7 slots then women may take short leaves,but 7 times.
    In one hand offering leave ,compassion and then stabbing at the back other side need full stop.

    In the starting of the ccl from 2008 to 2010 many women like me took ccl after exhausting all EL at credit. As there were no conditions present at that time, the conditions imposed retrospectively have been a great loss to many women like me, who has lost some 75 days of EL in order to avail ccl in those early years of ccl introduction. There are two other women in my office who have suffered this loss. Can something be done about this to get back our lost EL which is encashed after retirement ?
