NIMHANS Battery – Benchmark disability under Intellectual Disability: Amendment in Rights to Persons with Disability Act, 2016 – Notification No. S.O. 4501(E) dated 09.12.2020

NOTIFICATION
New Delhi, the 09th December, 2020
S.O. 4501 (E) .—In exercise of the powers conferred by section 56 of the Rights to Persons with Disabilities Act, 2016 (49 of 2016), the Central Government hereby amends the guidelines notified for the purpose of assessing the extent of specified disabilities in a person vide number S.O. 76 (E), dated the 04th January, 2018, namely:
2. In the said notification, in Annexure II of the Said guidelines, – under the heading “IV Intellectual Disability”, – in paragraph 22 relating to Specific Learning Disability, –
a) in sub-paragraph 22.3, after the word “paediatrician”, the words “or psychiatrist” shall be inserted.
b) sub-paragraph 22.4, shall be substituted, namely:-
“National Institute for Mental Health and Neurosciences (NIMHANS) Battery shall be applied for diagnostic test for SLD. Any person having tested positive on NIMHANS Battery shall be considered as a person with benchmark disability i.e. disability of more than 40%.”
c) In paragraph 22.5, for item (b), the following item shall be substituted , namely:-
“(b) Paediatrician or Paediatric Neurologist or Psychiatrist (where available)‟
