7th Pay Commission Leave: Formal & Informal Clarifications

Amidst the confusion surrounding the implementation of the 7th Pay Commission’s leave policies, both formal and informal clarifications are being sought by employees. The new leave policies have left many unsure about the extent of their entitlements, as well as the calculations of their leave balances and encashment amounts. Therefore, employees are reaching out to their respective HR departments, as well as seeking answers from colleagues and online forums, in order to fully understand the new policies and how they will affect their work and personal lives.

What is WRIIL Leave?

 

WRIIL, which stands for Work Related Illness and Injury Leave, is a recently introduced type of leave granted to employees who suffer from an illness or injury during their official duties. This leave provides employees with the time they need to recover from their illness or injury while still receiving their regular pay and benefits. The WRIIL ensures that individuals do not have to suffer financially due to the misfortune of being injured or becoming sick while performing their job duties.

On the 30th of August 2019, the Department of Personnel and Training issued an order regarding amendments in the CCS Leave Rules. This came into effect after the implementation of the 7th Pay Commission, which affected the leave entitlements of government employees and the way that leave is calculated and granted. This order was issued to ensure clarity and consistency in the implementation of these new policies.

Before proceeding, it is recommended that you take a moment to review the previous office memorandum published by the Department of Personnel and Training (DoPT) on 11th December 2018. Child Care Leave (CCL)

Rule 43-C has been updated to include some significant changes regarding Child Care Leave (CCL). These changes are as follows:
(a) For the first 365 days of CCL, an employee may receive 100% of their leave salary, while for the following 365 days, they may receive 80% of their leave salary.
(b) Single male parents, including unmarried, widowed, or divorced employees, are now eligible to receive CCL.
(c) Single female Government employees may be granted CCL up to six times in a calendar year. However, other eligible Government employees will only be granted CCL up to a maximum of three times in a calendar year.

Work Related Illness and Injury Leave (WRIIL)

The previous regulation, “Special Disability Leave for injury intentionally inflicted” under Rule 44, has been replaced by a new Leave called “Work Related Illness and Injury Leave (WRIIL).” This new leave may be provided to any Government employee, whether permanent or temporary, who experiences an illness or injury that is caused by or worsened by the performance of their official duties or as a result of their official position.

In light of the introduction of WRIIL, “Special Disability Leave for accidental injury” (under Rule 45) and Hospital Leave (under Rule 46) have been eliminated. The benefits of WRIIL include full pay and allowances for all employees throughout their entire hospitalization period due to WRILL.

The WRIIL policy has specific guidelines for government servants, military officers, and personnel below the rank of officers of GAFF regarding hospitalization. After hospitalization, government servants (excluding military officers) will receive full pay and allowances for six months. After that, they will only receive half pay for the next 12 months, which may be changed to full pay if the employee’s leave account is debited with corresponding HPL days. On the other hand, officers of the Central Armed Police Forces (GAFF) will receive full pay and allowances for six months after hospitalization and only full pay for the following 24 months. Personnel below the rank of GAFF officers will receive full pay and allowances, with no time limit. If the Workmen’s Compensation Act, 1923 applies, the leave salary payable under WRIIL will be reduced by the compensation payable under the Act. Lastly, no EL or HPL will be credited during WRIIL.

Vacation Department

As a result of recent amendments to Rule 28 and Rule 29, government servants serving in a Vacation Department are now allowed to take Earned Leave in lieu of Half Pay Leave. This change in policy is intended to provide more flexibility for these individuals to manage their time off and ensure that they are able to take the necessary breaks from work to maintain their health and wellbeing. With this new option available to them, these dedicated public servants can now enjoy greater work-life balance and rest assured that their needs are being taken into consideration.

The 7th Pay Commission Leave refers to the leave policy that was introduced by the 7th Pay Commission for the central government employees.
