What says FR 22(I)(a)1 Rules?

The rule provided options to an employee to fix his pay on promotion or MACP upgradation by two ways. One is date of promotion and another is date of increment (either 1st January or 1st July). Format of Option under FR 22(i)(a)(1).

Availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in context of CCS (RP) Rules, 2016-regarding.

OFFICE MEMORANDUM

Subject: Availability of option for fixation of pay on promotion from the Date of NextIncrement (DNI) in the lower post and method of fixation of pay from DNI, ifopted for, in context of CCS (RP) Rules, 2016-regarding.

Prior to implementation of 6th CPC Report, the pay fixation on promotion was governed by provisions of FR 22(I)(a)(1). In 6th CPC context, the first part of FR 22(I)(a)(1) was replaced by Rule 13 of CCS (RP) Rules, 2008. Similarly, consequent upon implementation of CCS (RP) Rules, 2016 in 7th CPC context, the pay fixation on promotion is regulated by the provisions of Rule 13 of CCS (RP) Rules, 2016.

This rule regulates pay fixation on promotion if the same is opted by the employee from the date of promotion itself. The issue of relevancy of provisions of FR 22(I)(a)(1) as well as the methodology of fixation of pay on promotion to a post carrying duties and responsibilities of greater importance, of a Government Servant in case he opts for pay fixation from the Date of Next Increment (DNI) has been considered in this Department.

2. In this context, proviso under FR 22 (I)(a)(1) inter-alia provides that the Government Servant (other than those appointed on deputation basis to ex-cadre post or on ad-hoc basis or on direct recruitment basis) shall have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion or to have the pay fixed from the date of accrual of next increment in the scale of the pay in lower grade.

3. After due consideration in this matter, the President is pleased to decide as follows:

(i) FR 22(I)(a)(1) holds good with regard to availability of option clause for pay fixation, to a Government Servant holding a post, other than a tenure post, in a substantive or temporary or officiating capacity, who is promoted or appointed in a substantive, temporary or officiating capacity, as the case may be, subject to the fulfilment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties or responsibilities of greater importance than those attaching to the post held by him/her.

Such Government Servant may opt to have his/her pay fixed from the Date of his/her Next Increment (either 1st July or 1st January, as the case may be) accruing in the Level of the post from which he/she is promoted, except in cases of appointment on deputation basis to an ex-cadre post or on direct recruitment basis or appointment/promotion on ad-hoc basis.

(ii) In case, consequent upon his/her promotion, the Government Servant opts to his/her pay fixed from the date of his/her next increment (either 1st July or 1st January, as the case may be) in the Level of the post from which Government Servant is promoted, then, from the date of promotion till his/her DNI, the Government Servant shall be placed at the next higher cell in the level of the post to which he/she is promoted

(iii) Subsequently, on DNI in the level of the post to which Government Servant is promoted, his//her Pay will be re-fixed and two increments (one accrued on account of annual increment and the second accrued on account of promotion) may be granted in the Level from which the Government Servant is promoted and he/she shall be placed, at a Cell equal to the figure so arrived, in the Level of the post to which he/she is promoted; and if no such Cell is available in the Level to which he/she is promoted, he/she shall be placed at the next higher Cell in that Level.

(iv) In such cases where Government Servant opts to have his/her pay fixed from the date of his/her next increment in the Level of the post from which he/she is promoted, the next increment as well as Date of Next Increment (DNI) will be regulated accordingly.

4. It is further reiterated that in order to enable the officials to exercise the option within the time limit prescribed, the option clause for pay fixation on promotion with effect from date of promotion/DNI shall invariably be incorporated in the promotion/appointment order so that there are no cases of delay in exercising the options due to administrative lapse.

5. In so far as their application to the employees belonging to the Indian Audit and Accounts Department is concerned, these orders issue in consultation with the Comptroller &Auditor General of India.

    Hello Sir,
    My Basic pay is 26800, Level 5, Cell 8 from January 2023 in Odisha Govt. Service.
    My increment date is January in each year.
    My 1st MACP date is 1st September 2023. i.e. 28200, Level 6, Cell 7
    I have promoted to Level 8 on 27.12.2023. i.e. 29200, Level 8, Cell 1
    Then what is my next increment date, amount and Level fitting?
    Please guide.

      This is to inform you that MACP & PROMOTION both the upgradation of basic will be treated not from the dates from your case January 2024 only. In view of both are from January 2024, so you will be given one upgradation of basic pay in Matrix Level 5 to 6 only as per the rules. From 1-1-2024 onwards as 27,400/- in cell stage 6 of Matrix Level 6.

    I was working in Pay Grade 2800 ,now I got promotion in pay level 6 ,grade pay 4200.Date of Next Increment before my promotion is 01.07.2023.

    Whether I Can opt for Date of Next Increment in January 2024 or I have to go for DNI in July 2024.

    My basic pay in 2800 pay grade is 37,000/- before promotion.what would be my basic pay after got promotion in 07.11.2023. Kindly guide me which benefits for me with elaborate.

      As per your promotion on 7-11-23 you opt JANUARY increment then from 1-1-24 as 38100 in MATRIX LEVEL 4 & 1-1-25 as 38700 in MATRIX LEVEL 5 as per the new rules.

    I was working in Pay Grade 4600 in Oct 2020 & My 3rd MACP was due in Oct 2020, & Date of Next Increment before MACP is 01.07.2021.

    Whether I Can opt for Date of Next Increment in January 2021 or compulsory .I have to go for DNI in July 2021.

    My basic pay in 4600 pay grade was 70,000/- what would be my basic pay after MACP in Oct 2020. and If I opt for DNI Jan 2021 what would be my Basic Pay.

    I was in pay band 3, GP 7600, Pay 96800 on 27.09. 2020. On assessment promotion to pay band 4, GP 8700 on 28.09.2020 my pay raised to 123100. Now question: is there any optional benefit whether fixation of pay in the promoted scale w.e.f. the date of next increment or date of promotion?

    I have been granted 3rd MACP in the month of April 2016, the date of my joining before the commencement of the 7th pay commission and after that, I have opted for the fixation of my in the 7th pay commission w.e.f. 1.7.2016 which is also the date of increment. In between DOPT have issued an order, those employees whose MACP occurred between Ist January 2016 to 30 June 2016 can change their option from Ist January 2016 and the next increment will be in July 2016. Can I change my option for fixation of pay from July 2016 to January 2016 now? please guide

      No. As per the rule CCS 10 your MACP not cover six months same on January. You will get get 2increments one increment normal & promotional increment in same MATRIX LEVEL on 1-7-16 & DNI on 1-7-17 in next MATRIX LEVEL stage of basic pay located or equal stage pay.

    my 3rd macp date is 1.8.,2022 from 4600 to 4800 i.e. from Level 70 to Level 8. My present date of increment is 1.7.2022. Pease let me know which date i opt for my next date of increment either 1.1.2023 to 1.7.2023 and which is benefitted to me.

    I got my 3rd MACP on 10 Aug 2019. Can I prefer option to get my DNI from Jan 2021…instead of Jul 2020…which would be beneficial?

      Yes correct. Give January increment option then 1-1-20 in same MATRIX LEVEL stage of basic pay equal or higher fixed & DNI as on 1-1-21 as next MATRIX LEVEL higher stage of increment basic pay. Check up that you shouldn’t 4th upgradations of basic pay fixation in service, if it it you will not get it.

    Dear Sir,
    I promoted in December 2021 in next level and the date of next increment is 1.07.2022. As I am retiring in February 2024, i.e. after two years, which option of pay fixation is beneficial for me.
    Should I opt for DNI i.e. 01.07.2022 or to get my pay fix on date of promotion i.e. 1.12.2021.
    If I go for option one, i.e. DNI, then my next increment will be on 1.01.23 or 01.07.23?
    Pl give detail reply. Thank you.

      Give January increment option so from 1-1-22 in same MATRIX LEVEL increment stage of basic pay & DNI from January 23 in next higher MATRIX LEVEL stage of basic pay, if the upgradations of basic pay is 3rd fixation in service.

    Sir,
    I was promoted from L10 to L11 on 7.12.2021, and my DNI is 01.07.2022.
    In this situation, can I opt for my pay fixation on the date of DNI i.e. 01.07.2022, and
    in such case what is the new date of my next increment after my pay fixation- i.e. 01.01.2023 or 01.07.2023?
    Please guide me in detail.

      If you’re upgradation of basic pay is less than fourth fixation from 1-1-22 next stage of increment in MATRIX LEVEL 10 & DNI on January 2023 in MATRIX LEVEL 11 stage of basic pay.

    I got 3rd MACP in 2015 with gp of 4800, afterwards I got promotion as PS in 2019 it is in level 7 as per 7 CPC now I got Promotion as SPS in 2022 it is in level 8 i.e. GP 4800. Now my question is that my fixation is not made when I got promoted in 2019 but can I get promotion fixation now as per FR 22(1) a(1)

      After 3rd promotion/3rd MACP upgradations of basic pay in service there’s no pay fixation. From the 6th CPC no pay scales for the post/designation.

      As per your promotion date (29-11-2021) you will be befitted with the January increment option from January 2022 in one (additional) promotional increment in same matrix level basic pay & DNI on 1-1-2023 onwards pay fixed in next Matrix Level. If July increment it will given on 1-7-2024 onwards.

    SIR, I WAS PROMOTED ON 20/2/2020 AND OPTED FOR THE DATE OF NEXT INCREMENT IN LOWER POST. MY PAY WAS REFIXED WITH TWO INCREMENTS WEF 01/07/2020. FURTHER, WHEN CAN I GET INCREMENT ON 01/01/2021 OR 01/07/2021

      As per the CCS Rules 10 six months pay should be in same MATRIX LEVEL so normal increment as on 1-7-2020 & if you’re giving January increment option then you will get 1-1-2021 in next higher MATRIX LEVEL increment onwards.. If you’re giving July increment option then on 1-7-2021 as old MATRIX LEVEL increment & next increment will be given only on 1-7-2022 only in higher MATRIX LEVEL.

    I was working as UDC having grade pay 2400 and I got the MACP having grade pay of 2800 susequently my pay was fixed giving one notional increment. Now I have promoted to the post of OS in the 7th pay commission having pay scale 35400-112400(level 6) accordingly joined duties on 10.1.18 and I was drawing a pay of rs.45400/ before my promotion I opted fixation after my normal increment due on July 18. How my pay will be regulated and what will be my pay on promotion on 1.7.18 and 1.7.19 Whether i will be entitled for notional increment on my promotion as OS.

      This is to inform you that from the 6th CPC & 7th CPC there is no pay scales for the promotional posts. You mentioned as 35400-112400 that was not for your O’S.post it was matrix table 6. Now-a-days (promotion) upgradation basic pay fixation of MACP on completion of 10th year only. So your pay fixation only from the GP 2800 to 4200 after the completion 10 year from that date of your joining date only. If you got in the middle as promotion O.S. there will be no monitory benefit only your designation changes as O.S. Normal increment on 1/7/18 as Rs.45,400 in level 5 only after 2nd MACP on completion of 20th year as level changes to 6 (GP 4600) and basic pay will be fixed at that time.

    1. I am little confused n hope you will help me. I am recruited on 28 Apr 2015. My date of birth is 19.06.1989 as per my date of birth i will retire on 30-06-2049. I want to no that which increment is good for me Jan 2016 or Jul 2016.

    2. It is possible to change my increment month from Jul to Jan.

      You are so many miles to go in Service, first early is better. In the MACP in upgradrations any how increment will be for you in January only. More over there will be no Pension benefits from the service 2004.

    I and my friend had joined in Rly as a helper on 07-10-2005 .I had got promotion to the post of tech.-3 on 19-02-10;tech.-2 on20-10 14.and tech.-1 on 01-07-17.Now my basic pay is Rs.31000/-.my friend had also promoted to the post of tech-3 on 31-12 09;tech-2 on28-12-15; and tech-1 on o3-07-18 .and now his basic pay is Rs.31900.why my basic pay is less than him?

      Because his first Promotion was on 31/12/2009 so his basic pay was fixed as basic pay plus new grade pay & D.A for that promotion as fixation & due to this his future increments of 3% was increased,, but that time your grade difference is less and also for that your D.A. is less as on 31/12/09 for you. Compare both of pay as on 31/01/2010. You got first Promotion only from 19/2/2010.

    Hallow sir my i was promoted on 26/01/17 from grade pay 4800/- to grade pay 5400/- and my pay was fixed on promotion on 26/01/17 Rs. 65000/- in table 10. I retired from service on 31/07/2017 (A/N). Do i eligible for my pay fixation on promotion from the next date of increment ie. 01/07/2017. No option was asked by my department defence rwgardibg this till date. What shiuld i do with regards to DoPT order dated. 27/07/2017
