Dopt Orders: Date of Birth Change in Service Records

The Department of Personnel and Training (DoPT) has issued orders regarding the alteration of the date of birth of a government servant, reiterating the instructions previously given. This order applies to cases where the date of birth recorded in the service records of the government servant is not consistent with their actual date of birth. The DoPT has emphasized the importance of ensuring accuracy in the service records of government servants and has outlined the procedure to be followed in such cases, including the submission of relevant documents and the involvement of a medical board. It is imperative that these instructions are followed to maintain the integrity and reliability of government records.

OFFICE MEMORANDUM

Subject : Alteration of date of birth of a Government Servant — reiteration of the instructions.

Rule 56 of Fundamental Rules states that except as otherwise provided in the rule, every Government servant will retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.

Provided that a Government servant whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years.

2. As per Note 6 below the aforesaid Rule, the date of on which a Government servant attains the age of fifty-eight years or sixty years, as the case may be, shall be determined with reference to the date of birth declared by the Government servant at the time of appointment and accepted by the Appropriate Authority on production, as far as possible, of confirmatory documentary evidence such as High School or Higher Secondary or Secondary School Certificate or extracts from Birth Register. The date of birth so declared by the Government servant and accepted by the Appropriate Authority shall not be subject to any alteration except as specified in this note. An alteration of date of birth of a Government servant can be made, with the sanction of a Ministry or Department of the Central Government, or the Comptroller and Auditor-General in regard to persons serving in the Indian Audit and Accounts Department, or an Administrator of a Union Territory under which the Government servant is serving, if —

(a) a request in this regard is made within five years of his entry into Government service;

(b) it is clearly established that a genuine bona fide mistake has occurred; and

(c) the date of birth so altered would not make him ineligible to appear in any School or University of Union Public Service Commission examination in which he had appeared, or for entry into Government service on the date on which he first appeared at such examination or on the date on which he entered Government service.

3. The Supreme Court of India in Civil Appeal No.502 of 1993 — Union of India Vs. Harnam Singh — Judgement dated 9th February, 1993 had observed that :
“Inordinate and unexplained delay or laches on the part of the respondent to seek the necessary correction would in any case have justified the refusal of relief to him. His inaction for all this period of about thirty five years from the date of joining service, therefore precludes him from showing that the entry of his date of birth in service record was not correct”.

The observations of the Apex Court was also circulated to all Ministries and Departments of the Government of India vide OM No.19017/2/92-Estt.(A) dated 19-5-1993.

4. All the Ministries and Departments are requested to keep the above in view while processing cases of requests for changes of date of birth.

    I am serving in a state police but I was not 18 year when I got the appointment letter but only after a month getting the appointment letter i attended 18 year. But it’s been 11 year now and I am still serving and only there are many problem i am facing it.
    Can I change my date of birth? If yes, then how??

      Download proof for it in their site and approved by the authorities then give it to your Office record.

    My date of birth in. Service book and sslc book is 8/2/1980.but my actual. Birthday in birth certificate is 7/2/1981.now 2 years in service. How can change date of. Birth in service book

      On what basis you have entered in you’re SSLC Book ? First you have to correct it in SSLC Book from your School. See that actually as per eligible year you’ve attended as per rule of Education Department for eligible age to appear SSLC Examination & also which age you have joined service is it rules permit for appointment, otherwise it will create more problems.

    My dob entered in service book is 21.1.1960as per higher secondary certificate whereas as per*matriculation its 21.1.1963. I also have acquired my birth certificate.
    I had joined service in 1983. I represented for correction of dob, but not acceded my request since it was late. Could you please send guide me.

      Which date is correct you get original birth certificate proof through COURT AFFIDAVIT, otherwise you will be retire on 31/01/2020, At this stage it is very difficult & it may treated from your office as a offence as per the government rules. In which date you got the PAN CARD for your future pension it should be given for your pension in the Bank. Moreover your past promotions if any may affect your seniority with your juniors due to if any changes arise your basic pay may lesser than now, it will affect your last basic pay at retirement. (Now your designation may revert) Due to this your service matters may change & your pension may take delay for this if corrections. In future you may get SENIOR CITIZEN’s FACILITIES MAY AVAIL EARLIER.
