Ministry of finance has issued an Office Memorandum regarding Revising Promotion Option under FR 22(1) (a).
Here there should not be any misunderstanding between Exercising Option for Pay Revision under CCS (RP) Rules 2016 and Exercising option for Pay Fixation for Promotion/MACP under FR 22(1)(a)
As per the provisions of FR 22 (l) (a) the Government servants have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion or from the date of next increment.
Some of the employees. promoted between 01.01.2016 and 25.7.2016 had opted for their pay fixation on promotion/financial up-gradation under MACPS from the date of their next increment in the lower grade. Consequent upon notification of CCS CRP) Rules, 2016 i.e 25th July, 2016. the option submitted by such employees has now turned out to be disadvantageous.
In some Department the Employees Promoted between 01-01-2016 and 25-7-2016 are allowed to exercise their Option to revise their Pay from the Date of Next increment i.e 1st July 2016.
But As per the provisos to CCS (RP) Rules 2016, they should not have been allowed to give option to revise their Pay beyond their date of Promotion Since it has been stated in CCS (RP) Rules 2016 under Rule No.5.
Now the Ministry of Finance issued an OM which says
“Under the changed circumstances after notification of CCS (RP) Rules. 2016. the employee may be allowed to exercise revised option for fixation of pay under FR 22(I)(a)(I). Such revised option shall be exercised within one month of issue of this OM Option so revised, shall be final”
After this Clarification there is confusion among Government servants those who got Promotion between 01-01-2016 and 25-7-2016 regarding how their Pay will be fixed…?
The Doubts are ..
1. What is the status of Employees promoted between 01.01.2016 and 25.7.2016 and opted to Revise their pay on Date of Next Increment i.e 1.7.2016 ?
i. Would they be asked to revise their promotion option under FR 22(1)(a) ?
ii. The option Exercised under the provisos to rule 5 of CCS (RP) Rules 2016 also to be revised again…?
iii. If one opt to fix the pay on Date of Promotion under FR 22(1)(a) and Opt to revise the pay on date of Promotion under Revised Pay Rules 2016, how the Pay will be fixed…?
The Concerned Departments / Federations may take up this issue to appropriate level for necessary clarification to clear the doubts of central government Employees.

Sir I joined Aug 2005 as LDC gp 1800 got 1st MACP on Aug 2015 In GP 1900 after that got promotion on 21.6.2021 in GP 2400.Taking BAsic pay Rs 33000/- as on date . please tell what option I should chose 1. From DOP 21.06.21 or DNI July 2021 and what is my DNI in both the options. Please guide.
July increment option. on 1-7-21 as 34,000 & DNI on 1-7-22 as 35,000 in MATRIX LEVEL 3 ( GP 2000) only not in 2400.
Sub:- Revised pay on DOP and pay fixation from DNI under FR 22(i)(a)(1) .
There is no confusion about switching over revised pay on date of promotion and fixation of pay from DNI under FR 22(i)(a)(1) who got Promotion between 01-01-2016 and 25-7-2016.
They are mixing switching over option and promotion pay fixation option which is not according to proviso 2 of Rule 5 of CCC(RP) Rules 2016 and DOE NOTE dtd. 19.03.2018 circulated by CGDA .
This Note indicates that the options for fixation of pay on promotion either from DOP or DNI
under FR 22(i)(a)(1) , it must be in revised pay structure not in pre revised pay (6cpc)
According to above Rules and DOE Note , first of all you have to opt to switch over the revised pay from DOP with multiplying Old Pay+GP+GP difference and then shifted to ex-post Level in pay matrix not in promotion Level under FR22(6cpc). Because your pay of promotion post has to be fixed from DNI and also to consider the OM of DOPT std. 27.07.2017.
If an employee delayed in exercising option beyond one month, what is the rule position and how will be done his pay fixation for 3rd MACP.
Please suggest on the matter.
Straight way I.e. on DOP
I am Tech- III (welder) of E C Rly, My basic pay was 26800/- in GP-1900/- as on 19.03.17 then I promoted in Tech -II GP 2400/-& I joined on 20.03.17 as Tec -II . What should my basic pay after fixation. please give detail.
There is no confusion in the clarificatory order issued by the Ministry.of Finance. If the option exercised earlier becomes disadvantage due to revision of pay, the employee can change the option again. This order is already exist.
It appears from the definitions given in the CCS (RP) Rules, 2016 for existing pay and existing scale, an employee is entitled to opt for fixation of revised pay either on 1.1.2016 with reference to the pre-revised pay admissible on that date or on the date of increment/promotion/MACP that were taken place between 1.1.2016.to 25.7.2016. In such cases, the revised pay is to be fixed with reference to the pre-revised pay fixed in the promoted post/MACP scale.
It is correct.
