DNI Issue: 1st of Jan Sunday or Gazetted Holiday?

Date of Next Increment Issue – 1st of Jan Sunday or Gazetted Holiday?

If a government employee is unable to assume their post in a specific grade pay on January 1st due to a Sunday or a gazetted holiday, the date of their next increment must be determined. OFB has requested clarification on whether or not an employee who is unable to join their post on January 1st due to a Sunday or a gazetted holiday can be considered to have completed six months of service on July 1st of that year to receive their annual increment. The CGDA HQrs Office has since clarified that if January 1st falls on a Sunday or a gazetted holiday, an employee who is unable to assume their post on that day will be considered to have completed six months of service on July 1st of that year to receive their annual increment. The affected cases should be handled accordingly.

Rule 40 of the CCS (Leave) Rules, 1972

Here’s what I can tell you about getting paid while on leave. If you’re a government employee and you take Earned Leave or Commuted Leave, you’ll still get paid the same amount as you were before you went on leave. This is according to Rule 40 of the CCS (Leave) Rules, 1972. However, if your normal date for a pay increase falls during your leave period, you won’t get the increase until you come back to work. Don’t worry though, your next pay increase won’t be affected by this delay.

Increment Rule 10 of CCS (RP) Rules, 2008

If you’re a central government employee, you might be interested in knowing about the annual and promotional increment. The Department of Personnel and Training has given some instructions on this topic, which I’ll summarize for you below:
– If you’re selected for a regular appointment but need to undergo training before starting your job, that training period can be counted as a duty to draw increments.
– If you’ve had broken spells in officiation in a higher post, you can still count those periods towards your increment under Rule 10 of CCS (RP) Rules, 2008.
– In the revised pay structure, increments will be granted on a uniform date every year – July 1st. If you’ve completed 6 months or more in the revised pay structure by that date, you’ll be eligible for an increment.
– If you’ve had less than 6 months of qualifying service due to EOL (without a medical certificate) between July 1st of the previous year and June 30th of the current year, your increment will be postponed to July 1st of the next year. This also applies to cases where the increment was due on July 1st, 2006.

Subject: Date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion/appointment on 1st of January of a year due to Sunday or Gazetted Holiday – Clarification regarding.

As per the provisions of Rule 10 of CCS (RP) Rules, 2008, w.e.f. 1.1.2006, in the case of all Central Government employees there is a uniform date of increment, i.e. 1st July of every year.

Government servants completing six months and above in the revised pay structure as of 1st of July are eligible to be granted the increment. From the above provision of CCS (RP) Rules it flows that Government servants who have rendered less than 6 months of service as of the 1st of July of a year will not be eligible to draw increment on that day and their date of increment will fall 12 months later on the next 1st of July.

Accordingly, all the Government servants who join posts in a particular grade on account of promotion/appointment, etc., on the 1st of January of a year will be eligible to draw their annual increment on the 1st of July of that year. However, those who join the posts between 2nd January and 30th June, will not be eligible for the same.

In light of the above position, some administrative departments have sought clarification from this Department regarding the date of the next increment in cases where Government servants are not able to join posts in a particular grade pay on promotion/appointment on the 1st of January of a year due to 1st of January falling on a Sunday or Gazetted holiday.

In this connection, it is clarified that in the normal course, if a Government servant was to join post in a grade pay on appointment/promotion on 1st of January of the year happened to be a Sunday or Gazetted holiday, the Government servants who join posts on the 1st working day of the year will be treated to have completed 6 months of service on 1st of July of that year to grant them annual increment on that day.

      Are you got any promotion from 12 to 22 you may not get MACP, if you have not got any promotion you will get MATRIX LEVEL changes as per your pay next cell in higher MATRIX LEVEL. Mention your basic pay as on 1-7-22?

    If I apply for EL on 1 day on 30-06-2023 and my DNI is 1 July. I could not join on 1 July 2023 as 01 July and 02 July was saturday and sunday respectively. I gave my joining report on 03 July, 2023. Am I eligible for increment from 01 July 2023 or will it be given from 03 July 2023.

    I got promotion on 30th Dec, 2022.I was on compensatory leave on that day. I joined the office on 02 Jan, 2023 and given the joining report on 02 Jan, 2023. Since i joined on 02 Jan, 2023, i am not getting increment on 01 July, 2023. My increment got postponed to 01 Jan, 2024.
    whether Office memorandum F.No.1/1/2008-IC, Dated 13 March, 2009 will be applicable to my case or not? please clarify

      Yes, you will get next annual increment on 1st July 2023 as rule for granting annual increment as on 1st July has not changed. Since rule is not changed so the clarification is still valid.

    Hello sir,
    I got a promotion on 30th December 2022. I was on compensatory leave on that day. I joined the office on 02nd Jan 2023 and was given the joining report on 02nd Jan 2023. Since I joined on 02nd Jan 2023 – I am not getting an increment on 01st July 2023. My increment got postponed to 01 Jan 2024.

      Compensatory leave is not at all counts as !eave it is as a permission only. When you are joining the duty is treated on the month of promotion, but as per the new rules CCS 10 six months same basic pay should be as a fixation in the same MATRIX LEVEL it will be in July 23 (normal increment & promotional increment) 2 increments & DNI on next year July 24 increment equal or next stage of basic pay in higher MATRIX LEVEL onwards.

        Dear sir,
        After promotion, My pay level changed from 4 to 6. i am getting new pay from the 02nd January, 2023. (i.e. cell 1 of Level 6)
        DNI is given on 01.01.2024.
        Since 01st January 2023, is Sunday – I couldn’t Join. I joined on 02 Jan, 2023. Hence am i eligible for DNI on July 2023 as per OM F.No.1/1/2008-1C, Dated 13 March 2009.
        You have mentioned as per the new rules CCS 10. would you please please give me any link of that. Actually i didn’t understand your reply – sorry sir

    Good evening sir, I have joined in 2019 and my next promotion due on 1.1.23 as UDC but due to holiday i will have to join on 2.1.23.
    My question is if I join on 2.1.23, my next promotion as ASO due on after five years on 1.1.2028. so will i get promotion on that day or I have wait for one more year. Bcz of joining on 2.1.23 will my residency period of five years complete or not

    My promotion is Due on 1/01/2023 But on 1 jab 2023 will be Sunday. I will go to the office on 02/01/2022. So in this condition, I know financial benefit will apply from 1 jan 2023 and the next Increment also be given on 01/07/23. But my Question is what is the date of charge of promotion Post is it 01/01/2023 or 02/01/23 . Because I on 01/01/23 was Holiday. Please clarify me.

      You are eligible for increment w.e.f.01/07/2022 since you are eligible for duty pay w.e.f. 01/7/2022 which is suffixed with your leave. Refer CCS Leave Rules 22(3)(b).

      Your increment will be given w.e.f. 1st July 2022 but only on notional basis. Actual benefit will be given w.e.f. date of resuming duties. As you were on leave on average pay (the pay which was drawn by you before proceeding for leave) from 13 June 2022 to 30 June 2022 as such increment will be released as and when you join after leave.

    If a Central Government employee remains on 3 days EL up to 30.06.2022 and as 01.07.2022 Gazetted Holiday for Odisha Region (due to Ratha Yatra), 2nd & 3rd July 2022 Saturday & Sunday Holidays……He is going to join on 04.07.2022. Then….. What will be the date of pay increase/ pay benefits, as his increment date falls on 01.07.2022 ?
    Will the pay benefits w.e.f. 04.07.2022 as he will report duty on 04.07.2022 on availing EL ? or Pay benefits from 01.07.2022?

      As per the rule CCS 10 on completion of six months same basic pay. Any how your promotion benefits will come effect from 1-7-22 as 2 increments in same MATRIX LEVEL & DNI on 1-7-23 of promotional increment in next higher MATRIX LEVEL onwards.In view of the joined duty on 3-1-22 as U.D.C. only the designation changes. This is inform you that from 6th CPC no pay scales only as GRADE PAY & in 7th CPC the MATRIX LEVEL changes higher. As per the Joining duty is to be reported day, this rules also covers leave rules.

    One official’s date of increment was 1st January, 2022, which was Saturday, 2nd January was Sunday (both was official holiday), 03-01-2022 was the first working day. But the official was unable to join his duty on 03rd January, 2022 due to suffering from COVID. He was joining office on 10th January, 2022.       If you’re fresh joined duty on 3-1-22 annual increment will be given on 1-7-23 as per the rules on completion from 7/22 to 7/23 Only. Seniority also counts from the joined duty on 3-1-22.

      Normally promotion in between January to June got promotion they are eligible usual increment & promotional increment both are from July increments in same MATRIX LEVEL as per the rules. From next year july will get promotional (next) MATRIX LEVEL basic pay fixed same or higher stage pay.

    1st July 2018 was Sunday and my date of promotion. However, I was on EL previous week uoto 29/06/2018 with 30/06/2018 and 01/07/2018 as suffix of EL. My office is denying me recent DNI from 01/01/2021 ( as per latest order) because they are considering my date of promotion as 02/07/2018. Is it correct?

      Not correct. 2-7-18 to 30-12-18 counts six months pay as per Rule. Old MATRIX stage of increment on 2-7-18 & same MATRIX LEVEL promotion increment on 1-1-19 with the option increment & DNI on 1-1-20 in next MATRIX LEVEL stage of located pay.

    I have got my promotion from 01.07.2018 , however, 1st July 2018 was Sunday so I could not resumed my duty. Previous week, I was on EL till 29.06.2018 , and 30.06.2018 and 0.17.2018 were suffix. Even though I was present at my station but could not join my duty on 1st July because of Sunday. My office is considering my date of promotion is 02.07.2018. Is it correct?

    SINCE JULY IS THE INCREMENT DATE FOR ALL CENTRAL GOVT. SERVANTS, I WAS ON LEAVE TILL 5TH OF JULY AND COULD JOIN DUTY ONLY ON 8TH OF JULY. IN BETWEEN 6TH AND 7TH WERE SATURDAY & SUNDAY.       If the kind of leave leave is C.L. it will be given on change.
      If It’s E.L./Commuitted leave/EOL it will be from joining duty date I.e.9-7-19.

      Mr. Maurya,
      You are not suppose to deny your annual increment, as per the FR SR Rule, if a Government employee is on leave on the 1st July, the increased pay will be drawn only from the date on which he resume duty and not from the first of July. That’s all. You are eligible for annual increment from 3rd July, 2019.

      If you are not on 1/7/19 increment day after joining date (10/7/19) you will get increment on that month as a pro-rate of increment, next month you will get full increment.

    central Government employees there is a uniform date of increment, i.e. 1st July of every year
    is this order issued by the GOI is mandatory of depends on the financial position of the orgranisation. Pl. provide the list of GOi offices where it is been adopted..

    Pay of a person is the total conscutive days in which he worked in that month, wether temperary or regular. Please tell me if a person on superannuation date falls on 31.3.2019 (bieng sunday) when should he be relieved from his duty as office is closed on 31.3.2019 being sunday.. for which date he will fill TR-1 for his relinguish of charge. For how much period he will draw salary if he get retired from service one day earlier as the last day of retirement falls on sunday.

    I was promoted to the higher post in the same office wef 01.09.2018 and I was present on the day at office and fulfilled my duties. Being Saturday, my date of charge assumption was not accepted by admin wef 01.09.2018. Instead, it is considered wef 03.09.2018 (Monday). Pay fixation in the higher post was done wef 03.09.2018. As I was on duty as on 01.09.2018, I become eligible to assume charge as on 01.09.2018 and get monetary benefits from the same day.

    Someone please clarify.

    Sir,
    I joined the present office on 2nd July, 2018 on promotion from the post of AO to CoA after getting relieved from the old station on 29-6-2018 from the post of AO. As 30th June and 1st July 2018 were closed holidays (Saturday and Sunday) I could join the new post at new station on 2nd July 2019 only. Kindly enlighten me with rule position regarding my 1st increment on promotion. Opinion of our Accounts section is that I am eligible to draw my 1st increment on 1-7-2019 as at I have not completed 6 months qualifying service for 1st increment as per 7th CPC .. Kindly give clarification on this .matter.

      In my opinion since it is same departmental promotion you are having joining time with journey time & you are eligible for increment in your AO post from your previous office. In view of this at least your service are continuing, you should get old matrix level increment. Clarify your matrix level has been changed due to your higher post, (normally from the 7th CPC there is no pay scales for promotions, except upgradation of MACP), In that aspect you are eligible increment on 1/7/19 in next higher matrix level with pay proctored.

    I joined PSU on 2nd January 2007 as 30th Dec. 2006 was weekly off, 31st Dec. 2006 was Sunday & 1st January 2007 was Id Ul Zua – Gazetted Holiday. 2nd Pay Revision was announced on 26th November 2008 w.e.f 1st January 2007. I wad denied of Pay Revision Benefit by the organisation stating I joined organisation on 2nd January 2007 instead of 1st January 2007. There were three consecutive Holidays and Govt. Circular cannot be made effective from Sunday or Holiday. I also gave a letter to the organisation that I shall be joining the organisation on 26th Dec. 2006 but company asked to join on 2nd January 2007 as offices will be closed on account of Holiday. Kindly advise, how to address this issue ? I am the seniormost officer in my department and four level junior is drawing salary higher than me.

      NOTE : Difference of 2 days salary on 1 & 2/1/17 (between new pay fixation 29/3 minus old pay 2/31 ) not your fixation of basic pay every month. Rule : Pay fixation on joining duty only, some of them may joins duty more than any numbers of days/months/years.

    The date of annual increment for one of our staff is on 1st January, and she availed Restricted holiday on that day. Now the matter is refer to me and my opinion is that she is eligible for increment on 1st January as she enjoy a sanctioned holiday, not a leave but I could not quote any relevant rule.

    m govt. servant of Manipur state. my promotion falls on 1.1.2019 due to retirement of senior officer on 31 December 2018, but authority is not in my favour to give promotion on 1st january and so they gave my promotion with effect from 2nd January. and has force me to take option for increment of promotion which i really dont like. plz advice.

      Since the order was charged your increment may be from 1/1/2019, because you have fully 6 months completed from 1/7/18 to 31/7/18.

    In case of a new appointment (fresh joining) in any department of central Govt. if that employee joined the department on 2nd January (as 1st January was Sunday) Under 7th pay commission (Joining date 02/01/2017) , will that the employee be eligible for his first increment in 01/07/2017 or does he have to wait till 01/01/2018? As in 6th pay It is mentioned that in case the 1st January is holiday or Sunday then the 1st working day of the year will be treated to have completed 6 months of service on 1st July of that year. So according to that will that employee be eligible for his first increment on 1st July of the same year in 7th pay commission also?

      In view of the Min. of Finance O.M.F.No.1/1/2008-IC dt.13/3/2009 there is no change in this O.M. continues in 7th CPC as it is acceptable increment on 1/7/2017. Previously actually one year has to complete service then only first increment will be given.

    Sir I had joined gujarat mineral development corporation Ltd on 11.03.2005. And in June 2005 18 LWP, and July 2005 21Lwp days approved and 01 days LWP in Jan 2006. I was joined in scale of 5500-175-9000.I have got my ist increment on April 2006 as per 5th pay fixation. But when the 6th pay fixation came on my increment came on July 2007 due to the one LWP on Jan 2006.and as per overall my increment delayed 16 month. Pl. Reply

    I got my fresh appointment on 15th april 2015. Am i eligible to get increment on 1st january every year from 2016 onwards instead of 1st july? I have been given increment 1 july 2016, 1 july 2017 and 1 july 2018, Please reply and clear my confusion.

      No changes in normal increment as completion of .one year after July. Only in the 6th CPC those who are upgraded from 1/9/2008 in the MACP Scheme they are upgraded next Grade Pay from the date and increment only on next completion of next year July only, but in the 7th CPC those who are got MACP Scheme from the date of 10th year & on completion of 6 months from July to December they will get increment changes from January. I appreciate your knowning the latest rules for others, this will also to know it through your dought of others also.

      No. Every year increment if completed one year from July to June. E.L will be deducted 1/10 of EOL.in July. For E.O.L. give medical certificate other wise it will not count for service.

      From the 6th CPC increment is from July to June on completion one year increment in July only, not from the joining date/month. Moreover if any up-gradation in pay from July to December on completion of six months then the increment will change in January only.

    My joining date 19.03.2012 and i promoted after 5 year on 19.03.2017. in the joining year my increments done after 16 months and in the promotion year my increment done will be after 9 months. now i suffering both of the cases. Is that any clarification please tell me

      From the joininng year increment should complete one-year, normal increment is from July only.i.e. from 7/13. Next you got promotion in 3/17 got higher next grade so you got before increment then on completion of 6 month in promotion from July to December your increment was fixed from January 2018. Your next increment will be on 1/1/2019.

    If the increment is released on 1st July 2017 and the government servant is on leave or absent on 1st July 2018 and joins on 3rd July 2018 then when to release the increment? Is it on 1st July or 3rd July?

      If the leave is C.L on 2nd , increment from 1/7/18, EL./COMMITTED LEAVE/E.O.L it will be only increment from 3rd or joining duty on that day.

    Is it applicable to those officials only who get promoted on 1st of january? Please clarify it if promotion happens to be on other date and falls on saturday and sunday or gazzeted holiday.how to fix dni in other case.

    I think the service Rules are Framed for the smooth functioning of the offices and for the benefit of the employees. Therefore, the Rule 10 of CCS (RP) Rules 2008 appears to be meaningless.

    From the language only the office order u have attached herein does not look like an authentic/original one. moreover, this is very surprising that there is no specific order/rule regarding this matter even as it is a matter of serious concern for all CG employees. Everyone has only guess and suggestion but no concrete answer. Very sad.
