Amendment of CCS Rules for Persons with Disabilities

The Department of Personnel & Training (DoPT) has issued a fresh set of Instructions to all Ministries/Departments granting relaxation in the Central Civil Services (Leave) Rules, 1972 for Disabled employees. In an Office Memorandum dated February 25, 2015, the DoPT has reiterated that the disabled employees will be entitled to pay, promotion and other service benefits even if they cannot be taken back to the post they were holding or are adjusted or kept waiting until a suitable vacancy arises.

The medical leave on account of disability will not be subject to ceiling under Rule 12 and any leave debited for the period after a Government servant is declared incapacitated shall be remitted back into his/her leave account.

The leave applied on medical certificate in connection with disability cannot also be refused or revoked without reference to a Medical Authority, whose advice shall be binding. Leave will also be granted even if the Government servant’s family member submits an application/medical certificate in case the employee is unable to do so on account of the disability.

The services of an employee can neither be terminated nor reduced in rank in case the employee has acquired a disability during his service. Any disabled employee who is not fit to return to duty shall be shifted to some other post. If that is not possible, the disabled employee shall be kept on a supernumerary post until a suitable post is available or he attains superannuation. Besides, no promotion shall be denied to a person simply on ground of his/her disability.

    I think, we all disabled person should put grievance to dopt for relaxation in office hours 30 minute in morning and 30 minute in the evening. Because we all have to face traffic jam and crowed. And can not walk or move frequently. That is why we have to face torture of their officers.

    I am physically handicapped . Is there any exemption/concession for handicapped employees in office attendance timing. Please intimate me if any order/circular issued by DoPT with No. and date on office attendance timing on my Email.

    Requesting to intimate any Govt Orders pertaining to Physically Handicapped people regarding exemption in office timings incoming and leaving the office.

    I am Sham Patil MACP not be given but Dilhi high court give judgment after 01/01/2016 benchmark good also superman courts order for benchmark good after 01/01/2016 Please give necessary action please Thank you

    I am physically handicapped with 74% with both legs and left arm paraparesis. Is there any exemption/concession for handicapped employees in office attendance timing. Please intimate me if any order/circular issued by DoPT with No. and date on office attendance timing on my Email.

    I am Central Government servant, my office hours time is from morning 9.30 am to evening 6 pm, I am 100% Physically Handicapped person, my both the Legs & Right Hand also amputed, distance from my residence to my office about 20 kms., I am report/ attend to my office regularly before 9.10 a.m. morning, but in the evening, I leave my office at 5.45 p.m. daily from Monday to Friday.

    Please let me know their is any Exemption from early or late attendance for Physically Handicapped Persons in the Central Government Office, if any circular or Order regarding this issued by the DOPT then please inform me the Order number and date immediately at my Email address.
