Payment of Life-Time Arrears of Pension (LTA)

Payment of Arrears of Pension: PCDA(P) Circular No. 226 dated 15.07.2022 with amended IAFA (CDA)-651 and IAFA (CDA)-652

The competent authority has further decided that in the case of Insane/Lunatic pensioners where arrears of pension or lifetime arrears of pension is due for the reason of non-drawal of pension for more than 12 months, Non-conviction certificate from nearest Police Station where the Insane/Lunatic pensioner was residing during the period of non-drawal of pension that he/she is not involved in criminal offence/case is not required henceforth. Cessation of Payment of Pension: When the pension ceases to be payable to a pensioner, the PDA will make necessary entries in the pension documents and its records and return them to the Pr. CDA(P) Allahabad.

Attachment of Pension: In accordance with section II of the pension Act(Act XXIII of 1871) no pension is granted by Govt. the on account of past services or present infirmities or as a compassionate allowance and no money due or to become due on account of any such pension or allowance, shall be liable for seizure, attachment or sequestration by process of any Court in India at the instance of a creditor for any demand against the pensioner or in satisfaction of a decree or order of any such court. While an order issued by a court can not prima facie be ignored and should, therefore, be honoured, the relevant orders may be brought to the attention of the court with a view to getting the court orders vacated and simultaneously the PDA should bring the matter to the attention of the PCDA(P) for further necessary action.

Payments of Insane Pensioners: When a pensioner is certified by a Magistrate to be insane, the payment of pension and gratuity shall be regulated by the competent authority as under Where the insane pensioner is lodged in an Asylum: The whole of the pension and gratuity will be paid to the dependents of the pensioners on the production of the pensioner’s pension certificate and life certificate. The question of payment by them of the cost of pensioners’ maintenance is left to be decided by the court on an application by the Asylum authorities under provisions of section 26 of the Lunacy Act. Where the insane is in charge of his/her dependents or of a friend or any other relative: The pension and gratuity will be paid to dependents or in two shares one to a person having charge of the lunatic and another to the dependents respectively.

Missing Pensioner: Payment of Family pension and gratuity to the family of Armed forces personnel/pensioners who disappear suddenly and his whereabouts are not known.
The above pension may be sanctioned by the Administrative/ Competent authority after obtaining the following documents:

Copy of FIR: Indemnity Bond from the family on the prescribed form.
Certificate from the PDA stating that
The period up to which pension was last paid.
The pension account of the missing pensioners has not been transferred to another PDA.
The following points are to be observed by the PDAs before making the payment of the Family pension to the family of the missing pensioner.

The pensioner’s name may be struck off the strength of the pension strength and included in form I.
The Family pensioner may be taken on payment strength and her name included in form II.
The following documents may be obtained from the family and submitted to this office separately from the vouchers.

Indemnity Bond: The certificate showing the period up to which pension was last paid to the missing pensioners and confirmation to this effect that his pension documents were not transferred to another PDA. In case the individual re-appears at a later date the payment of pension to the family shall be stopped and the case reported to PCDA(P) office.

The payment made to the family may be included in the change statement: The date of disappearance of the pensioner will be reckoned from the date FIR is lodged with the police. The family pension will be sanctioned by the PCDA(P) on receipt of the documents/information from the PDA after one year from the date of lodging FIR commencing from the date of lodging FIR.

LTA will be paid to the legal heir after the presumptive date of death has been notified by the Ministry concerned/administrative authorities.

Payment of life time arrears of pension (LTA)

LTA is the Pension for the period it was not drawn during the lifetime of a pensioner. According to Arrears of Pension (Nomination) Rules, 1983, pensioners are required to nominate another person, during his/her lifetime to receive the arrears of pension, due to the pensioner on his/her death. This is paid to the nominee, and if there is no nominee, lifetime arrears can be claimed by the legal heirs and settled. However, time-barred claims will be settled by the sanction of the concerned Pension Sanctioning Authority.

Payment of Life Time Arrears: Pension for the period it was not drawn during the lifetime of a pensioner should not be paid after receipt of information about his/her death. According to Arrears of Pension (Nomination) Rules, 1983, pensioners are required to nominate during their lifetime another person to receive the arrears of pension due to the pensioner on his/her death. This is paid to the nominee, and if there is no nominee, lifetime arrears can be claimed by the legal heirs. Time barred claims are settled by the sanction of the Pr. CDA(P) Allahabad.

Payment of Time-Barred Pension/Arrears: If the pension payment has not been made for want of prescribed periodical certificates for not more than one year, the arrears can be paid on being duly claimed to the satisfaction of the PDA. Before the payment of pension which has not been drawn for more than 12 months, is made, Pension Disbursing Agencies should look for the sanction of the competent authority. Pension Disbursing Agencies should not make any payment in respect of such time-barred claims without the sanction of the competent authority.
If the period stated above exceeds one year, PDA should send an arrears claim on the prescribed form to the Pension Sanctioning Authority. Only on receipt of sanction for payment of pension, it can be resumed.

With a view to avoiding delay in sanction of arrears/ Life Time arrears of pension claims, certain powers have been delegated to the P.D.As, as per details given below :

NOTE: Cases, where the power to waive the time bar, rests exclusively with CDA(P)/Principal CDA(P), Allahabad are as under:-

Where pensioner has acquired foreign nationality. In the case of acquiring the nationality of South Africa and Israel, however, sanction of the Government of India will be required.
L.T.A. claim in respect of a pensioner who is struck off pension establishment for failure to draw his/her pension for more than three years without any explanation and ultimately dies without ever applying for re-admission to pension establishment.
